Do you require a Public Practice Certificate?

CPA Australia requires any member who is offering public accounting services to be of CPA status and hold a Public Practice Certificate. This applies to anyone closely associated with a firm, whether as a principal or a director, a consultant or an officer of the practice entity.
Next tranche of Stronger Super legislation
Treasury has released draft legislation, which includes provisions relating to superannuation fees, intra-fund advice and insurance. Proposals also include disclosure of trustee or director and executive remuneration, as well as investments held and managed by superannuation entities on behalf of members.
Draft APRA prudential standards
The Australian Prudential Regulation Authority (APRA) has released 11 draft prudential standards for comment. The draft standards seek to impose minimum requirements on superannuation trustees to prudently manage member funds. CPA Australia publishes open letter to Minister
CPA Australia and the Institute of Chartered Accountants have published an open letter to the Hon. Bill Shorten, Minister for Financial Services and Superannuation, in the Australian Financial Review, as part of a public awareness campaign to emphasise the important role that professional accountants play in the community and for over two million small-to-medium businesses in Australia.
Superannuation and limited recourse borrowing (PDF)
The Australian Government has released Exposure Draft – Corporations Amendment Regulations 2012 proposing to make limited recourse borrowing arrangements (LRBA) "financial products" under the Corporations Act 2001 when entered into by superannuation funds. A person dealing in an LRBA will be required to have an Australian Financial Services Licence and meet the disclosure requirements where the product is issued to a retail client. The regulations will commence three months after the day they are registered. Members can email their comments to finplan@cpaaustralia.com.au by Monday 5 March.

Code of Ethics for Professional Accountants
CPA Australia has made a submission to the International Ethics Standards Board for Accountants regarding proposed changes to Code of Ethics for Professional Accountants, related to provisions addressing a breach of a requirement of the code.
APES 310: Dealing with Client Monies
APES 310 Dealing with Client Monies became effective 1 July 2011, with early adoption permitted. APES 310 replaces APS 10 Trust Accounts and Guidance Note 3 Operation of Trust Accounts. The standard has been divided into two parts – obligations of members who deal with client monies, and obligations of trust account auditors on their compliance with this standard.

Members who are undergoing their review in the first half of 2012 are reminded that planning meetings must be held by Friday 30 March, reviews must be completed by Friday 22 June and the review report must be sent back to CPA Australia by Friday 13 July, or 15 business days after the review (whichever is sooner). An exposure draft on the Proposed Guidance Note APES GN 30: Outsourced Services (GN 30) has been issued by the Accounting and Professional Ethical Standards Board. GN 30 provides guidance to Members in public practice who provide or use outsourced services. Auditor independence and firm rotation

CPA Australia has made a submission (PDF) to the Public Company Accounting Oversight Board on its concept release on auditor independence and audit firm rotation. CPA Australia considers the status quo adequately addresses auditor independence and, given the absence of specific evidence pointing to improvements in audit quality as a result of the proposals, does not support the proposed changes of introducing mandatory audit firm rotation.

Revised ethical standards

The Accounting Professional and Ethical Standards Board has issued revised APES 330 Insolvency Services (PDF) and APES 210 Conformity with Auditing and Assurance Standards (PDF).
APES 330 replaces the existing standard and will be effective for insolvency services commencing on or after 1 April 2012, with early adoption permitted. APES 210 replaces the existing standard and is effective from 30 September 2011.
New Zealand audit regulations for accredited bodies

Auditing – submissions, standards and exposure drafts
CPA Australia has lodged a submission to the Public Company Accounting Oversight Board (PCAOB) in response to the PCAOB concept release on possible revisions to its standards. The Joint Accounting Bodies have made a submission to the International Auditing and Assurance Standards Board in response to the proposed standard on assurance engagements other than audits or reviews of historical financial information.
The Auditing and Assurance Standards Board has issued exposure drafts on proposed standards relating to corporate fundraisings and comfort letters, and Treasury has released Exposure Draft Corporations Legislation Amendment (Audit Enhancement) Bill 2011.

The guidance statement was first issued in 2008 to help auditors conduct SMSF audits. GS 009 was updated to help auditors comply with the new auditing standards and ATO requirements that have been released since GS 009 was first issued.

Bill Shorten, released the first tranche of Future of Financial Advice (FoFA) draft legislation which represents a critical next step to ensuring the provision of high quality financial advisory services.

Public practitioners – we need your views
The International Federation of Accountants (IFAC) Small and Medium Practices (SMP) Committee is seeking public practitioners’ views on the issues impacting them. The SMP Quick Poll will allow IFAC and CPA Australia to understand the challenges public practitioners are facing and tailor resources, such as the Guide to Practice Management for Small- and Medium-Sized Practices, to meet these challenges.
